Agency accepts nine enforcement undertakings
The Environment Agency accepted nine enforcement undertakings in June and July, all for breaches of the Packaging Waste Regulations.
Enforcement undertakings are one of six kinds of civil sanction approved by the government in 2010 (ENDS Report, February 2010). The agency can accept undertakings from firms that breach certain environmental regulations in place of prosecution.
Firms found or admitting to be in breach of regulations are invited to propose what they will do to stop the failure continuing. Typically this means joining a packaging compliance scheme and introducing procedures to ensure data is collected.
They must also offer an appropriate payment to an environmental cause to compensate for any financial benefit resulting from their breach.
The largest compensation payment in the June-July batch is £24,601, which was donated to the Grasslands Trust by food importer Rondanini UK Ltd, which is based in south-east England. The second largest donation was £14,648, which was split equally between the Wildfowl and Wetlands Trust and the Westonbirt Arboretum by food and disposable item supplier Good Morning Disposables.
The third largest donation was £11,520, given to the Woodlands Trust by buckle and fastener supplier the Ace Supply Co Ltd.
Other companies offering enforcement undertakings include feed suppliers Dugdale Nutrition, electronic music equipment supplier Korg UK, extruded plastic manufacturer Homelux Nenplas, tent maker Kampa UK and shotgun cartridge maker Lyalvale Express.
All of the above companies were caught by the agency in breach of the packaging regulations and were therefore “reactively responding” to the agency. Only one firm came forward and offered an undertaking after discovering it was in breach of the regulations. This was poultry meat supplier Lincs Turkeys.
