In the first High Court decision concerning the interpretation of the 1994 EC Directive on packaging and the UK's implementing regulations, the court has given a broad meaning to what is meant in law by packaging, and has held that it can encompass plastic pots used during the sale of plants and shrubs. If the court had upheld the original approach of the magistrate, it could have given a green light for many manufacturers to have products excluded from the scope of the regulations.
