Wind farms and statutory nuisance
In what appears to be the first case if its kind, residents living near a wind farm have lost a case alleging a statutory noise nuisance in the local magistrates' court. The case, which lasted over five days, was heard by a full-time district judge, and although the decision does not create any binding precedent, his written reasons provide some useful legal guidance and emphasise the importance of expert evidence in such cases.
