Scotland goes its own way on IPPC and ‘access to justice’

Proposals to integrate EU rules on public participation into three existing environmental regimes - air quality planning, nitrate vulnerable zones, and integrated pollution prevention and control (IPPC) - were issued by the Scottish Executive in March.1 They differ from Government plans in England and Wales on one major issue - whether existing law and practice comply with the EU provisions requiring the public to be able to challenge official decisions on IPPC permits.
