Marine pollution case referred to European Court for clarification

A recent High Court case has raised questions about the compatibility of international law on marine pollution from ships with a recent EC Directive designed to stiffen penalties in this area. The court granted leave for judicial review of the Secretary of State’s proposed implementation of the Directive on grounds concerning its legal validity, but stayed proceedings pending a reference to the European Court of Justice on key issues raised by the claimant.
