Common law liability of sewerage authorities

In the seminal Marcic case, the House of Lords held that an individual householder, plagued with back-flooding from overloaded sewers, could not sue a sewerage undertaker in private nuisance. The High Court has recently revisited the principles and held that the decision does not mean sewerage undertakers are immune from all common law actions concerning inadequacies in the sewerage system.
