Court of Appeal opens way for claim under shellfish Directive

The Court of Appeal has accepted that a breach of standards laid down by the 1979 EC Directive on shellfish water quality could give rise to a claim of damages for economic loss suffered by a fisherman. In doing so it overruled a significant part of the decision by the High Court which had ruled out such a claim in 1997.
