Shellfishermen challenge Agency over water quality
The UK may again be risking legal action by the European Commission over its implementation of the 1979 EC Directive on shellfish waters. Solicitors acting for shellfishing interests have told the Environment Agency that its plans for applying new regulations designed to implement the Directive are "unlawful". The dispute involves the Agency's plan to set "operational standards" which are less demanding than the EC guideline values. The shellfish industry argues that in establishing programmes to achieve the operational standards, the Agency is not "endeavouring to observe" the guideline standards as the Directive requires.
