Environmental assessment legally required for road scheme

The High Court has held that a local authority's decision to approve a road scheme where no environmental assessment was required was legally defective. The case appears to be the first in which the court has been prepared to quash a project where no assessment was carried out, and may herald a more vigorous judicial approach to this area of law.
