Agency wins another case on legal definition of waste
The extensive legal meaning of waste being developed at European level has received a further endorsement from the Court of Appeal. In Attorney General Reference 5/2000 (Court of Appeal, Criminal Division, 4 May 2001), the Court held that condensate produced by an animal rendering plant and spread on land as a fertiliser remained waste for the purposes of controls under Part II of the Environmental Protection Act 1990, even though it had not been subject to any recovery process.
