Landowner's liability for public nuisance

The Appeal Court has held that Railtrack was liable in public nuisance for the environmental problems caused by pigeons roosting on a railway bridge across a busy urban street. The decision contains an important review of the principles of legal liability where nuisances are permitted to occur though not directly caused by a party, and as such has wider implications for the environmental responsibilities of landowners.
