Law of the Sea tribunal refuses injunction on MOX plant

In a decision which has brought it to the forefront of contemporary environmental debate, the International Tribunal for the Law of the Sea has refused to grant the Irish Government a preliminary injunction to prevent the operation of the MOX nuclear fuel manufacturing plant at Sellafield pending a full arbitration hearing. The result will have relieved the UK Government and British Nuclear Fuels, but the Tribunal was strongly critical of the lack of cooperation between Ireland and the UK and ordered them to take immediate steps to rectify the situation.
