Injunctions and human rights

In an important consolidated set of appeals, the Court of Appeal has for the first time considered the significance of the Human Rights Act for its powers to issue injunctions for breaches of planning control. The decision means that courts will have to exercise their powers with greater discretion than some previous case law had implied, and the result could affect other areas of environmental law where injunctions are sought.
