Time limits for challenging planning decisions
In a decision with significant implications for developers and planning authorities, the House of Lords has held that time limits for commencing judicial review proceedings should generally begin from when planning permission was granted rather than any earlier date. The judgment is a reversal of recent decisions which had insisted on prompt applications to the courts in the interests of good administration, and although concerned with a planning decision has wider application to other environmental decision-making.
