Economic losses from oil pollution damage

The High Court has held that indirect economic losses arising from oil pollution are not recoverable under the key statutory compensation scheme. The judgment underlines the difficulties of incorporating economic losses in civil liability schemes, and follows the reasoning of the Scottish Court of Session in the 1999 Landcatch case which arose out of the Braer oil spill.
