Noise nuisance and the public interest

The High Court has broken new ground in developing the principles of common law nuisance in a case brought against the Ministry of Defence in respect of noise from military aircraft. The judgment demonstrates the influence of the Human Rights Act in how the courts now approach such cases, and the outcome could have significant implications for governmental and other public works giving rise to potential nuisance claims.
