Ever since the Royal Commission on Environmental Pollution published its seminal fifth report on air pollution in 1976, the relationship between planning controls and more specialised pollution control laws has been a subject of considerable legal and political interest. A recent decision of the High Court has raised the issue again, and revealed some potentially disturbing problems.
