Powers to accept enforcement undertakings for permitting offences were granted to the Environment Agency (EA) in 2015 in a move intended to encourage wrongdoers to offer financial reparations rather than go to court. As part of the enforcement undertakings process it is the offenders’ responsibility to put forward a fair remedy for the damage it has caused.
