Open-cast coal mine appeal thrown out by Planning Inspectorate

The Planning Inspectorate has thrown out an appeal and refused planning permission for a new open-cast coal mine in Derbyshire

Plans to create an open-cast coal mine on the outskirts of Clay Cross in Derbyshire have been stymied by the Planning Inspectorate.  

Provectus Remediation submitted a planning application for the mine to Derbyshire County Council in January 2016 but in the absence of a decision the company appealed to the inspectorate under section 78 of the Town and Country Planning Act 1990 citing the council’s “failure to give notice within a prescribed period of the decision”.
