EA prosecutes in first order banning illegal handling of waste

The EA has charged an illegal waste operator with a CBO for the first time

A Somerset builder prosecuted for dumping and burning waste has been given a five-year Criminal Behaviour Order (CBO) and 150 hours community service.

It is the Environment Agency’s (EA) first order banning someone from handling waste.

A CBO is similar to an Antisocial Behaviour Order (ASBO) but a breach under a CBO is declared a criminal offence, with a maximum sentence of up to five years’ imprisonment or a fine.

Bernard Molloy pleaded guilty to dumping and burning illegal waste in a field near Crewkerne, in Somerset.
