DEFRA updates guidance on legal definition of waste

The government has refreshed its advice on the legal definition of waste and the latest European and national case law

The environment department (DEFRA), the Welsh government and the Department of the Environment Northern Ireland, have published new guidance on the legal definition of waste.

The basic definition of waste – material which a holder intends or is required to discard – has been embedded in waste legislation for three decades. But the latest report, which was consulted on in 2010 (ENDS Report, January 2010), incorporates recent case law where the definition of waste may not be straight forward.
