Lords ruling on motorway inquiry disallows public challenges to Government forecasts

The House of Lords decision to overturn an Appeal Court Order for the re-opening of a public inquiry into the Government's projected M40 and M42 schemes has major implications for objectors wishing to challenge official forecasts at public inquiries.

By a 4-1 majority, the Law Lords ruled on 7 February that the Appeal Court was wrong to quash the Environment Secretary's approval of the motorway schemes and to order a further inquiry hearing. The Appeal Courts's decision (ENDS Report 32, p 9) upheld claims by motorway objectors that there had been a denial of natural justice at the 100-day public inquiry into the motorway proposals.
