'Disappointing' fines for West Midlands firm for illegal dumping of cyanide wastes

Fines totalling £2600 have been imposed on Brasway and Brasway (Waste Disposal) Ltd of Wednesbury, West Midlands, and four of the firm's employees, for the illegal disposal of over 500 tonnes of cyanide wastes. The defendants had pleaded guilty to charges brought under the Deposit of Poisonous Wastes Act 1972 and the Dumping at Sea Act 1974, and were sentenced after an eight-week trial at which nearly 200 witnesses were heard at Wolverhampton Crown Court.

The charges related to the illegal dumping of cyanide wastes at sites in Derbyshire, Shropshire and the West Midlands, and at sea off Birkenhead. However, because of the offences took place before Section 16 of the Control of Pollution Act 1974 was implemented, the local authorities in whose jurisdiction the dumping occurred are unable to recover the costs of removing and disposing of the dumped wastes.
