Business gets extra defences in proposed EU liability rules
The European Commission has caved in to industry pressure at the last minute by allowing two defences against strict liability in its proposal for a Directive on environmental liability.1 The changes mark a further retreat from its original plans and have been strongly criticised by environmentalists - while industry is now focusing on getting a financial cap on liability into the legislation.
