Causation, risk and the limits of civil liability

The difficulties of proving the causation necessary to establish civil liability where a number of sources may be the cause of injury has been well illustrated by an important decision by the Court of Appeal. The case concerned workplace exposure to asbestos, but the principles contained in the judgment may well be relevant to environmental damage where exposure to chemicals and other substances has caused harm.
