Owner liability for vehicles involved in fly-tipping

In a short but important decision, the High Court has held that the owner of a vehicle involved in fly-tipping of waste can be assumed to be in control of the vehicle for the purposes of offences under the Environmental Protection Act 1990. The decision will have come as some relief to the Environment Agency faced with producing prosecution evidence.
