Key Lords decision on causation and risk in asbestos case

The House of Lords has now given its full reasons for its decision in May to allow an appeal by workers suffering injury from exposure to asbestos, and in doing so has comprehensively rejected the Court of Appeal's more traditional approach towards causation tests in civil liability claims. The decision will be viewed with alarm by insurers, and is likely to be of immense importance to future claims concerning damage from exposure to chemicals where the limits of scientific understanding and proof are being reached.
