High Court rejects cement tyre burning challenge
The High Court has rejected a legal challenge to the Environment Agency's approach in permitting the burning of tyres in cement kilns. The lengthy judgment of Mr Justice Silber contains a number of important rulings concerning the nature of the Agency's duties under Part I of the Environmental Protection Act 1990, especially during a period of continual policy change, the approach to interpreting its decision documents, and the extent to which courts should review its technical judgments.
