Commission draws in its horns with latest liability ideas

A consultation on the European Commission's current ideas for a Directive on liability for environmental damage was launched on 30 July.1 The consultation, based on a short working paper, shows a growing emphasis on procedures for securing the restoration of damage. Key changes include limitation of the scope of a liability regime and a lesser role for environmental organisations. Apparent restrictions on the use of monetary valuation techniques will limit the scheme's innovativeness.
