Court of Appeal refuses to quash MOX decision

The Court of Appeal has rejected environmental groups' appeal against November's decision by the High Court to uphold the Government's authorisation of the new MOX nuclear fuel manufacturing facility at Sellafield. However, the ruling contains a significant variation on the interpretation of the relevant EC law which suggests that the so-called justification test will present a considerable hurdle should a further programme of nuclear power stations be proposed.
