Waste management and insolvent companies

The legal problems facing the Environment Agency when dealing with insolvent waste management companies continue to develop. The Court of Appeal has held that leave of a court is required before the Agency can prosecute a company in administration for an environmental offence. But it has given some guidance on the exercise of that discretion, and indicated that creditors' interests should not always override the public interest in environmental protection.
