Breach of EIA Directive requires planning decision to be quashed

The House of Lords has held that a court has very limited discretion to uphold the validity of a planning decision where there has been a failure to apply the EC Directive on environmental impact assessment. The ruling sends a powerful signal concerning the importance of compliance with EC rules which may well have implications for other areas of Community environmental law.
