Agency skirts round EC law on groundwater rules for landfills

A long overdue framework for reviewing landfill licences for compliance with the 1980 EC Directive on groundwater protection has been set out in an Environment Agency consultation paper.1 It offers some comfort to landfill operators by proposing that discharges of "List I" substances should be able to continue if they are not "discernible" - but on this point and several others the Agency's thinking may be out of step with the EC requirements.
