Marine oil pollution and liability for economic losses
In a case arising out of the Braer oil spill, the Scottish Court of Session has held that the statutory compensation scheme for marine oil pollution does not extend to indirect economic damage. The judgment underlines the general reluctance of the courts to permit liability regimes to apply to economic damage in the absence of express statutory language.
