European Court continues to extend reach of EIA Directive

In a recent ruling concerning the 1985 EC Directive on environmental assessment of major projects, the European Court of Justice has reaffirmed its tough stance towards Member States which attempt to exclude categories of projects from the scope of the Directive. And it has confirmed that individuals may rely on the Directive to bring challenges before national courts where it is inappropriately applied.
