Retrospective environmental assessment and forestry
An important judgement has been delivered by the Scottish Inner House - the equivalent of the English Court of Appeal - concerning the application of environmental assessment requirements to afforestation projects. The ruling is believed to be the first to raise the possibility of requiring a retrospective assessment where procedures have not been properly followed - a principle which may have wider application.
