European Court denies access to environmental organisations

The European Court of Justice has ruled that Greenpeace and other environmental interests do not have the standing to challenge a decision of the European Commission concerning structural funds. The judgement confirms the 1995 decision of the European Court of First Instance (ENDS Report 252, pp 43-44 ) and, while consistent with the European Court's case law, will disappoint those hoping for a more liberal interpretation of the Treaty. Any further progress on standing is now likely to require amendment of the Treaty.
