Equipment failure no defence in landfill leachate case

A recent House of Lords decision which underlined the strict nature of liability for the offence of "causing" water pollution has made an early mark in a case involving a discharge of landfill leachate. The landfill operator has been fined £2,000 after the High Court ruled that the unforeseeably early failure of a rubber seal which led to the escape provided no defence in law.
