Interim injunctions in public law proceedings

The High Court has recently considered the principles to be applied in considering whether to grant an interim injunction in judicial review proceedings. The case, R v Ministry of Agriculture, Fisheries and Food and another ex parte Monsanto, concerned the statutory pesticide approval scheme contained in the Control of Pesticides Regulations 1986 and the 1991 EC Directive on plant protection products, but the court's approach will have wider implications, and indicates a reluctance to protect private commercial interests where public law is concerned.
