Compensation for unlawful waste disposal

The question of compensation where waste disposal has been carried out in breach of a private contractual arrangement concerning the use of land was recently considered by the High Court. The decision in Ind v Plant Hire Company (Stroud) Ltd (High Court, 4 November 1998) illustrates the overlap between private law remedies and statutory regulation. It also contains an unusually intensive examination of the meaning of "inert" waste which turned out to be a critical term of the contractual arrangement.
