Agency's powers of investigation and self-incrimination
A prosecution for illegal disposal of clinical waste has raised important procedural issues concerning the Environment Agency's powers to demand information from those whom it is investigating with a view to possible prosecution. Despite the arguments of the company involved that it could resist providing information on the grounds of potential self-incrimination, the Court of Appeal has ruled that certain of the statutory powers are in favour of the Agency.
