Compensation for nuclear contamination

In one of the largest ever awards for environmental contamination in the UK, the High Court has held that the Ministry of Defence (MoD) should be liable for almost £5 million as a result of radioactive contamination which prevented a major property deal from taking place. The decision in Blue Circle Industries plc v Ministry of Defence (Chancery Division, High Court, 26 November 1996) has clarified the extent to which compensation for economic losses under the Nuclear Installations Act 1965 are recoverable, and the judgement contains valuable insights into the problems of estimating such losses where complex property valuations are involved.
