Civil action against sewage works

A fishing club has lost a civil action in negligence and nuisance in respect of alleged pollution of a lake caused by a Welsh Water sewage works. The decision of His Honour Judge Daniel in Hughes v Dwr Cymru Cyf (Llangefni County Court, 21 June 1995) contains some important findings of fact, especially concerning the effect of phosphate discharges on inland fish stocks, together with some potentially important rulings on relevant legal principles. But his judgement is not always expressed in the clearest of language, and is to be challenged on appeal.
