The EC groundwater Directive and waste disposal

A recent High Court case has raised complex issues concerning the interpretation of the 1980 EC Directive on groundwater and its application to licensing of waste disposal sites. The decision in R v Vale of Glamorgan Borough Council and Associated British Ports ex parte James (Queens Bench Division, 10 August 1995) appears to raise more problems than it answers, and may be subject to an appeal.
