Power station in second ECJ ruling on environmental assessment
A second ruling on the 1985 EC Directive on environmental assessment of major projects has been made by the European Court of Justice. As with the first case last year (ENDS Report 237, p 43 ), Commission v Federal Republic of Germany (C-431/92, ECJ 11 August 1995) involved proceedings brought by the European Commission against Germany, and while the result does not involve any dramatic reassessment of the Directive, it nevertheless provides some important points of interpretation.
