Strict liability regime emerges for transfrontier waste shipments

A draft protocol on liability and compensation under the Basel Convention on the transboundary movement of hazardous wastes emerged in September. The latest draft would create a strict liability regime, but a core group of industrialised countries - including the UK - is said to be seeking amendments to the text to allow a defence of due diligence on the part of waste generators and to provide for joint liability of waste disposers alongside generators.
