Appeal against emissions trading penalty fails
A decision in March by the Welsh Environment Minister in Alphasteel v Environment Agency is the first appeal decision against the imposition of a civil penalty under the greenhouse emissions trading regime. Although not a court judgment, the decision followed a formal hearing under an appointed inspector which raised fundamental challenges to the regime.
