Personal injuries can still be claimed under public nuisance

The Court of Appeal has held that as a matter of law it is still possible to claim for personal injuries arising out of an action in public nuisance. The court has accepted that, in the light of recent case law from the House of Lords, the principle may need reviewing but this can only be done by the highest court in the land - the House of Lords.
