Community competence on criminal offences concerning pollution

Tensions between member states and the European Commission as to whether community legislation should intrude on national powers to determine criminal offences have risen again in a recent decision of the European Court of Justice. Future disputes appear more likely to be resolved by political and procedural argument rather than court action.
