Waste removal notice may override requirement for a waste licence

The High Court has considered a novel point of law on the statutory power of waste authorities to serve notices requiring the removal of illegally disposed waste. The court held that a notice could require treatment to be done on site, even if it involves an offence under other parts of the legislation. In effect, statutory remedial provisions trumped the provisions on the need for a waste management licence.
